Court seeks written reply from Adiala Jail admin

RAWALPINDI - Lahore High Court (LHC) Rawalpindi Bench here on Thursday directed Adiala Jail authorities to submit their reply in response to four petitions moved by the prisoners who are in jail despite completing their term. LHC Justice Jamila Jahnoor Aslam issued these directions on four identical petitions filed by prisoners Javed Iqbal, Muhammad Ibrar, Nisar Ahmed and Allah Yar. The prisoners moved the court under section 491 of Criminal Procedure Code 1898 through their lawyer Muhammad Siddiq Mughal and made Inspector General Prison Punjab and Superintendent Central Jail Adiala as respondents. According to the details, a petitioner Nisar Ahmed stated in his petition that he was sentenced in five different cases and his sentence on concurrent and consecutive basis was to run from March 30, 2000 while his maximum sentence was of 10 years. He maintained that his probable date of release came to January 18, 2006 and despite more than three years passed but the petitioner had not been released from jail. The second petitioner Allah Yar told the court that he was convicted life imprisonment and his sentence was to run from September 2, 1985 while his probable date of release came to April 25, 2009. But, he added that despite more than three months period passed and he had not been released. Another petitioner Javed Iqbal informed the court that he was convicted in different cases ranging between one to three years and his sentence was to reckon from May 20, 2003 while his maximum punishment was of 7 years. He added that his probable date of release came to October 21, 2008 and despite more than eight months period passed but the petitioner had not been released from jail. Fourth petitioner Muhammad Ibrar stated in his petition that he was convicted 10 years imprisonment and was reduced to 7 years by the LHC and his appeal before Supreme Court is pending. He added that his sentence was to run from May 3, 2005 and his maximum sentence was of 7 years while his probable date of release came to February 7, 2009 but despite more than three months period passed and he was not released from jail. The petitioners contended that their detention is unlawful and they entitled to be set at liberty. They prayed in their petitions that they may be released from Central Jail Adiala and be treated in accordance with law.
