KARACHI - A Single Bench of Sindh High Court (SHC) Justice Attar Saeed disposed of the petition moved by National Commodity Exchange Limited (NCEL) and Karachi Stock Exchange (KSE) against issuing notices to pay taxes by Income Tax Department. The Income Tax Department official appeared before the court to submit his comments, where he told the court that his department has withdrawn the notice pertaining paying taxes to both the plaintiffs. He maintained that both the petitioners should not be bothered by any official of the said department anymore. NCEL and KSE filed a suit by submitting that on Nov 2, 2008, the Income Tax Department sent notices to them for paying income taxes, in which they raised objections for the miscalculation in the tax. In response, they had moved to the tribunal against the said notice. They maintained that when the matter was pending on tribunal, the said department again on April 2008, sent another notice for paying the tax. Whereas, the latest notice was sent to them by the said department on May 23 and the date line to pay the tax was till May 28. They further submitted that the Income Tax officials have also reached to the banks where they hold their bank accounts for the withdrawal of cash, but the bank officials refused them regarding withdrawal of the case from their accounts.
