ISLAMABAD -  Special Assistant to Prime Minister on Law Barrister Zafarullah said if the Constitutional Amendment Bill 2017, which seeks fresh delimitation of electoral constituencies, is not passed from the Senate then elections could be held on the basis of old census report .

He was talking to media persons at the Ministry of Law and Justice on Thursday. He said for preparation of the bill consultation took place between Pakistan People’s Party and Pakistan Muslim League-Nawaz leaders.

Barrister Zafarullah hoped that the Senate will pass the bill but in case it is not passed then the general elections 2018 will be held on the basis of old census .

He said that he had prepared six draft bills regarding inheritance of agriculture land in Islamabad, partition of immovable property in Islamabad, Islamabad Criminal Law Prosecution Services Act 2017, Islamabad Food Authority Act, 2017, and amendment in section 54, and 166 of the Code of Criminal Procedure, 1898 regarding arrest and registration of FIR.

Zafarullah said in the federal capital there is no law for the inheritance of agricultural land. Therefore litigation in this regard has continued in the civil courts. We have simplified this issue and after that law, tehsildar who has all the land record will have the power to pass order to divide the property among the heirs.

The other issue in Islamabad is the transfer of immoveable property. The price of plots in Sectors E and D is worth million of rupees. He said the heirs of the plot fight over the property. Therefore through this legislation there will be internal auction process and one who gives the highest bid will get the plot and the money of it will be distributed among the heirs. The auction will be through civil court order.

Barrister Zafarullah said there is no prosecution branch in the federal capital, adding currently it is done by police. He said all over the world investigation is separate from prosecution. Now under Islamabad Criminal Law Prosecution Services Act 2017 the prosecution branch would be established, he added.

There is no food authority in the federal capital. With the introduction of Islamabad Food Authority Act the authority will be set up and its members would be Mayor of Islamabad its head, CDA representative, one member from the government department, which controls ICT, Scientist, Food Technologist, one member from Chamber of Commerce and one member from Traders Union. The authority would be empowered to decide about the food business, label and the food additives. The authority will also have power about the food operator/seller licence.

Assistant to Prime Minister for Law said the amendment is proposed in CrPc in section 54A regarding the arrest. Before the arrest, the police would have reasons to the accused and will also inform about it to his family. There is no procedure of arrest, seizure and search.

The amendment in section 166 of CrPc will empower magistrate to award sentence to the police officer if he refuses to lodge an FIR.

He said the punishment under 182 of PPC will be enhanced from six months to 10 years for filing a frivolous petition against anyone.

He said people should send their comments over the proposed draft bills in one week.
