ISLAMABAD - The Islamabad High Court on Friday summoned Islamabad Police Inspector General on a petition moved challenging the transfer of an FIR registered against former CIA station chief in Islamabad Jonathan Banks, over the killing of people in a drone attack, from the federal capital to FATA.
IHC judge Justice Shaukat Aziz Siddiqui took up the petition and directed the Islamabad IG and the SHO Secretariat Police Station to appear before the court in person at the next date of hearing.
Later, the court deferred the hearing till January 14.
During the hearing, AG Mian Abdul Rauf appeared before the court and Mirza Shahzad Akbar represented the petitioner, Karim Khan.
On April 7, 2015, the same IHC bench had directed the IG Islamabad police to register the FIR against the former CIA station chief and the former CIA legal counsel John A Rizzo.
The Secretariat Police registered the FIR but later, it was transferred to the FATA Secretariat.
Petitioner Karim Khan has asserted that the Secretariat Police Station Islamabad had no jurisdiction to transfer the case. He has prayed to the court to direct the Secretariat Police to initiate its proceedings on the basis of the FIR.
The IHC bench had directed police to register the FIR against the former CIA officials for their alleged involvement in drone attacks wherein Karim Khan’s brother and his son had died in a drone strike.
The petitioner who is a resident of North Waziristan Agency had lost his teenage son Zahinullah and brother Asif Iqbal who was a primary school teacher in Mirali, in a drone strike on December 31, 2009.
