LAHORE - A Full Bench of the Lahore High Court Wednesday reserved judgment on a constitutional petition filed earlier against the appointments made by Speaker Punjab Assembly while Acting as Governor Punjab in 2008. This judgment will decide fate of Justice (r) Jahangir Arshad as chairman Services Tribunal Punjab and Khalid Mehmood as Ombudsman Punjab who had been appointed by the acting governor. The petition was filed by PPP Finance Secretary Aurangzeb Burki against the powers of the acting governor to make appointments of permanent nature like Ombudsman and chairman of the Service Tribunal which PA Speaker did secretly during Eid Holidays in 2008 while holding post of acting Punjab governor. The petitioners counsel Ch Fawad advocate in his arguments asked the court to define the ambit, scope of powers and authority of Governor as per article 101 of the constitution and that of Acting Governor as per article 104 of the constitution. Ch Fawad submitted that the acting governor was not authorised to make appointments of permanent nature on key posts during temporary charge. The PPP leader stated that the said appointments amounted to overstepping the authority and use of the power that did not vest in the office of Acting Governor. Petitioner prayed to the court to invalidate the appointments as unconstitutionally made.
