ISLAMABAD - The Supreme Court has accepted the petition for preliminary hearing against the appointment of Chairman Security and Exchange Commission of Pakistan (SECP).
A three-member bench of the apex court, headed by Justice Tassaduq Hussain Jilani, has also appointed Chaudhry Aitzaz Ahsan and Khalid Anwar as amicus curiae in the case against the appointment of Chairman SECP M Ali Ghulam Muhammad. Petition was filed by a sacked official of SECP’s Law Division Ashraf Tiwana.
During the hearing, counsel for applicant Afnan Kundi contended that appointment of SECP’s chairman was the violation of fundamental rights. He questioned that how a broker could be appointed as chairman SECP. The learned counsel also alleged that nepotism in the SECP was on the rise after taking the charge by incumbent chairman.
Meanwhile, counsel for SECP, objecting the hearing of the petition, said that Supreme Court was not proper forum to challenge the appointment of SECP’s chairman. He said that applicant should approach High Court in this regard.
Upon this, Justice Mian Saqib Nisar said that now it’s time to decide the criteria about filing of direct petitions in the apex court. The court has also appointed Chaudhry Aitzaz Ahsan and Khalid Anwar as amicus curiae and adjourned hearing of the case till November 19.
