ISLAMABAD - The Islamabad High Court (IHC) Tuesday suspended operation of a sessions court’s order in which it directed the police to register FIR against senior officials of the Securities and Exchange Commission of Pakistan (SECP).
Justice Riaz Ahmad Khan issued these orders in a petition of SECP Director Abid Hussain who challenged the sessions court’s order directing the Kohsar Police Station for registration of first information report (FIR) against senior officials of Securities and Exchange Commission of Pakistan on the application of Deputy Director Securities and Exchange Commission of Pakistan Rana Mustafa Yousaf. While issuing pre-admission notices to the respondents, the IHC bench suspended the operation of the sessions judge’s orders.
Justice Riaz observed that even if the allegations of Rana Mustafaa were correct, he could file a contempt of court petition and could seek legal remedy but FIR could not be registered. Then, he adjourned the proceedings in this matter with date in office.
Earlier, a sessions court had directed the Kohsar police station to register FIR against senior officials of Securities and Exchange Commission of Pakistan on the application of Rana Mustafa Yousaf.
Rana Mustafa had stated before the sessions court Islamabad that the higher management officials of SECP had stopped him from entering the Securities and Exchange Commission of Pakistan premises on June 28 and restrained him performing his official duties. Therefore, the sessions court judge had ordered the Kohsar police station to register the FIR that was registered against the acting Chairman Securities and Exchange Commission of Pakistan Tahir Mehmood, Commissioner Zafar Abdullah and Director Abid Hussain.
However, Justice Riaz Ahmad of IHC suspended the operation of the said order here on Tuesday while stating that no cognisable offence was made.
According to details, the employment contract of Rana Mustafa was not confirmed by the SECP after the lapse of his probationary period of six months. He then filed a petition before the IHC and obtained a stay order in this regard.
It is also worth mentioning here that Rana in May-June this year had also filed a petition in Sindh High Court (SHC) and obtained a stay order against the acting charge of Tahir Mahmood as Chairman Securities and Exchange Commission of Pakistan.
But, the Supreme Court of Pakistan struck down the stay order on June 07 while observing that the petitioner Rana Mustafa had submitted a fake affidavit before the SHC.
