ISLAMABAD - The Supreme Court on Monday ordered the home secretaries of Federally Administered Tribal Areas (FATA) and Provincially Administered Tribal Areas (PATA) to produce the complete record of the detainees and the periodical report prepared by the review board.
Chief Justice Iftikhar Muhammad Chaudhry, heading a three-member bench, stated that they wanted to examine whether the detainees are being treated as per the regulations and the law is being adhered. The Chief Justice said that executive should take steps to extend federal laws to FATA and PATA. He made it clear that they would not allow any parallel judicial system regarding the trail of detainees in internment centres.
The bench also comprised Justice Jawwad S Khawaja and Justice Sheikh Azmat Saeed hearing the missing persons cases said it should not happen that people are arrested and put in the internment centres.
The Chief Justice said: "If somebody has committed a crime then he should be dealt in accordance with law therefore don't ruin the lives of their families." The state is responsible for security and protection of its citizens, the CJP said and, added they would not tolerate enforced disappearances of the people. Justice Chaudhry warned that people should not be picked up without evidence and kept in the detention centres unlawfully. Justice Jawwad said that 514 persons have been kept in the seven internment centres in Khyber Pakhtunkhwa. He said it was court's desire that the government itself resolves the missing persons issue.
During the hearing Amna Masood Janjua, chairperson Defence of Human Rights Pakistan, apprised the court of the abduction of two brothers Obaidullah and Mulazim Hussain. She said Obaidullah was kidnapped from Bhakkar and Mulazim from DI Khan one year ago in front of the family members in the official vehicle and FIRs were registered, but so far they are not aware of their whereabouts.
The Chief Justice noted that unfortunately the name of agency was not mentioned in the FIRs. He directed the Inspector Generals of Police Khyber Pakhtunkhwa and Punjab to recover Obaidullah and Mulazim and produce them before the court. Justice Chaudhry asked the Additional Attorney General (AAG) Tariq Khokar to arrange the funds for the relatives of the missing persons, who come to attend the apex court for their recovery, in light of the Justice (Retd) Mansoor Alam's Commission report.
Earlier, the Chief Justice directed the AAG to arrange the Mohammad Jamil, a missing person, meeting with his relatives by tomorrow (Tuesday) and submit its report on 17th July and adjourned the hearing.
