Islamabad - A division bench of Islamabad High Court yesterday suspended an IHC single bench’s order regarding registration of FIR against three doctors who allegedly did a wrong diagnosis a wrong diagnosis resulting in the termination of twin pregnancy.
The IHC division bench comprising Justice Noor-ul-Haq N Qureshi and Justice Athar Minallah issued these orders while hearing an intra-court appeal (ICA) filed by Dr Rizwan Oppal of Islamabad Diagnostic Centre (IDC).
It was April 27 when an IHC single member bench comprising Justice Shaukat Aziz Siddiqui had directed Margallah police to register FIR against three doctors of Islamabad Diagnostic Centre (IDC) and Ali Medical Hospital (AMH) including Dr Naushaba of IDC, Dr Rizwan Oppal of IDC and Dr Shamsa of AMH.
A petitioner Urooj Nasir in her petition before the IHC had contended that the doctors murdered her babies due to wrong diagnosis. On Thursday, Tariq Mehmood Jehangiri Advocate while representing Dr Rizwan in the ICA adopted before the court that IDC just performed ultrasound on the complaint of Urooj Nisar.
He contended that she took medicine from another hospital and her miscarriage was done in another hospital. Besides, Pakistan Medical & Dental Council (PMDC) is an authorised forum for registration of the complaints against the malpractices and misconduct of doctors and Urooj Nisar has already filed a complaint at PMDC that is pending adjudication there. After hearing his arguments, the IHC dual bench suspended the single bench’s order and adjourned the hearing in this matter till next week for further proceedings.
The petitioner Urooj Nasir adopted before the court that the doctors murdered her babies. Urooj told that she went to the police station to lodge an FIR but they refused in this matter. Later, she filed a case before a civil court under section 22/A for registration of FIR but her petition was dismissed on January 09, 2016.
The petitioner through her counsel Raja Nisar-ul-Haq Advocate argued before the court that on October 20, 2015 she went to the IDC for a medical check-up as she was pregnant. One Dr Naushaba performed a detailed ultrasound on her and told that she is suffering from ‘Ecotopic Pregnancy’ and if she does not terminate her pregnancy, there was high risk to her life.
He continued that upon hearing this, the petitioner went to AMH and showed her ultrasound report to one Dr Shamsa who immediately administered her with injections and tablets.
The counsel added that on October 26, 2015 petitioner went to another laboratory in Blue Area for ultrasound and the doctors at that centre said that she is pregnant with twin babies those are five weeks in age and quite healthy. Upon hearing this petitioner felt grieved, as she had already taken pills and injections to terminate pregnancy. The same day petitioner went to IDC and told them about her recent reports. A doctor at IDC performed ultrasound to her and endorsed the findings that she is pregnant with twin babies and they were healthy. One Dr Rizwan of IDC took from her the previous medical report where it was suggested to terminate the pregnancy and gave the petitioner another report.
