islamabad - A local court will today (Saturday) resume the hearing of a petition moved against the departure of former military ruler Pervez Musharraf.
In this matter, Additional District and Sessions Judge Pervez-ul-Qadir Memon had issued notices to ministry of interior and inspector general (IG) of Islamabad police and directed them to submit reply in this regard on April 2 (today).
The application was filed by Haroon Rashid Ghazi, son of deceased cleric of Lal Masjid Abdul Rashid Ghazi, through his counsel Tariq Asad Advocate.
Previously, the judge had remarked that non-bailable arrest warrants of Musharraf had been sent to police and legal action would be taken against the responsible persons if they failed to implement the arrest warrants.
In his application, the petitioner stated that the trial of Musharraf has been under way by learned Additional Session Judge Islamabad, Wajid Ali since October 31, 2013 who passed over 25 orders for his appearance, but the respondent never appeared before the trial court and repeatedly filed applications for his exemption and all such applications were dismissed by the learned Judge and finally the said learned Judge passed orders of non-bailable warrant on April 02, 2015.
The counsel Tariq Asad added that former president then filed criminal revision application before the Islamabad High Court. During the arguments, his counsel undertook on behalf of the respondent that he would appear in person on the next date of hearing before the trial court.
He continued that the IHC bench, on this undertaking, disposed of the revision. But the respondent instead of appearing before the trial court again filed criminal revision in the IHC with another medical certificate. The court passed the order giving another opportunity to file application for exemption before trial court under S540-A CrPC. Advocate Tariq said that the respondent, thus filed another application for exemption under S540-A CrPC. The case was transferred to another learned judge, namely Kamran Basharat Mufti, the acting district session judge (west), Islamabad, who also passed an identical order dismissing the application for exemption of respondent filed under Section 541-A CrPC.
He adopted that Musharraf again filed criminal revision against the order of the session court. The case was fixed before Justice Aamer Farooq. He set aside the order and remanded it to for decision afresh on the application for exemption after providing the petition opportunity to substantiate his present medical condition. During hearing it was pointed out that the learned judge, Kamran Basharat Mufti had been the Secretary in the Lal Masjid Commission appointed by the Supreme Court.
Therefore, the acting Sessions Judge Kamran Basharat Mufti thus marked the case to Pervez-ul-Qadir Memon to hear the application afresh.
He maintained that this court has finally passed the order dated 20-02-2016 issuing non-bailable warrants of the respondent/accused.
Then, he prayed to the court that since non-bailable warrants have been issued by this court; hence orders be passed to the IG Police and Ministry of Interior to inform all the airports and outlets not to allow the departure of Pervez Musharraf/accused and to arrest him and produce him before this court.
