ISLAMABAD – A petition was moved in the Supreme Court on Wednesday, seeking the court’s direction regarding the release of a boy, who is allegedly under the illegal detention of spy agencies.
Tariq Asad Advocate, the counsel for 11 missing prisoners, has filed the miscellaneous petition regarding the release of the detainee namely Jamshed Raza, who was implicated in Pervez Musharraf attack case.
The counsel said that accused was granted bail by Anti-Terrorist Court Rawalpindi on June 15, 2011 but Superintendent District Jail Adyala had refused to release on ‘Robkar’ as the Addition District Magistrate Islamabad had passed detention order for 15 days but later on Islamabad High Court has set aside the detention order against him.
He said that despite the clear directive of the IHC, jail authorities did not release the detenue as he was handed over to Sama Satta police in one old bank decoity case registered in 2003.
Tariq Asad said that the detenue was also released from Anti-Terrorist Court Bahawalpur on August 9, 201 but later on he was abducted by intelligence agencies. He further stated that the petitioner had tried to register FIR against the persons of spy agencies but could not succeed. “The petitioner for the same was sent to the Director General Human Rights Cell Lahore High Court for the registration of FIR on November 16, 2011 but FIR was not registered against the nominated accused intelligence agencies, Superintendent and Deputy Superintendent Jail Bahawalpur,” he added.
The leaned counsel contended that it is evident that the detenue was abducted by spy agencies (ISI and MI) in an unlawful manner in violation of Article 4,9,10,10-A and 14 of the constitution.
He requested the court that spy agencies be directed to release the detenue in the interest of justice and public importance.
