ISLAMABAD - Former army chief Pervez Musharraf’s legal team has decided to invoke the jurisdiction of the Special Court and file an application for its direction to stop the cabinet members from issuing statements in the sub-judice matter as well as a contempt petition against Defence Minister Khawaja Muhammad Asif over his press statement in the pending case.
The legal team, comprising Syed Shariufddin Pirzada, Dr Khalid Ranjaha, Anwar Mansur Khan, Ahmed Raza Kasuri, Raja Ibrahim Satti, Rana Ijaz Ahmed Khan, Dr Muhammad Ali Saif, Aftab Maqsood and Chaudhry Faisal Hussain, will file the two applications in the Special Court on Monday (tomorrow).
The application, seeking a direction to stop the cabinet members from issuing statements in a sub-judice matter, alleged the prime minister and the members of his cabinet were frequently giving statements with a criminal intention to influence the court.
“The statements issued by the prime minister and the cabinet members are contempt of this honourable court and amount to interference in its authority. The statements tend to prejudice the case of the applicant and influence and obstruct the proceedings pending before this honourable courtm”, the draft of the petition said.
The legal team of Musharraf has made Defence Minister Khawaja Asif’s press statement a ground for contempt of court application against him, saying it amounts to interference in the authority of the Special Court and tends to prejudice the case of the applicant. The team will pray to the court to summon Khawaja Asif and proceed against him in accordance with the law.
