ISLAMABAD - Hearing various missing persons cases, the Supreme Court observed Tuesday that if the State is blamed for enforced disappearance of citizens then it is very dangerous.
Heading a three-member bench, Justice Jawwad said no one tells the court truth, while its purpose is to bring the facts in limelight and find out reality. Advocate General Khyber Pukhtoonkhawa Latif Yousafzai submitted a report regarding missing person Sultan Hussain. According to that Sultan case is in the Inquiry Commission on Enforced Disappearance.
After going through the report, Justice Jawwad remarked that some times missing persons cases in the Commission are put in the cold storage. The court ordered the advocate general to provide a copy of the report to the petitioner and adjourned the case for 10 days.
In the missing person case of Usman Ghani and Abdul Rehman, the Advocate General Punjab informed the bench these persons were in the jail of Faisalabad and five FIRs have been registered against them. The AG Punjab further told that these persons were presently detained under MPO. The court directed the advocate general to submit the report about them on 8th May.
About missing person Abdul Manan, the bench was informed that Manan was missing since 8th September 2013. According to the police, Manan contacted another missing person Mujahid Azam Tariq on 23rd September on his mobile phone.
The police further informed that according to the mobile phone data at that time Abdul Manan was in Lakki Marwat. They also told that Abdul Manan talked to another person on PTCL number and they were trying to collect that information and in that had given application to the PTA.
Justice Jawwad said that enforced disappearance of the citizens was not good, adding if someone had committed crime then he should be tried according to the law.
The case was adjourned till tomorrow. The court directed Additional Inspector General KPK to assist the Punjab police in that case.
