Islamabad - The Supreme Court was requested to fix the hearing of the constitutional petition challenging the 21st constitutional amendment and creation of military courts.
Muhammad Ikram Chaudhry, counsel for the petitioner Chairman Pakistan Justice Party Munsif Malik, filed an application before the apex court, requesting for fixing the petition for hearing on February 12.
The petitioner had filed a constitutional petition in the apex court on January 9, 2015, praying for declaring the 21st constitutional amendment and creation of military courts were ultra-vires and against the basic structure of the constitution.
He had made federation of Pakistan through secretary ministry of law and justice, secretary ministry of defence, speaker national assembly and chairman senate as respondents. Muhammad Ikram Chaudhry requested the apex court to fix the hearing of the instant petition on February 12, saying that another connected petition of Lahore High Court Bar Association verses Federation is already fixed for hearing on the same day hence petition of Munsif Malik be also fixed for hearing in the best interest of justice.
Earlier, a three-member bench of the apex court on January 28 while hearing the petition of Lahore High Court Association (LHCBA), challenging the 21st constitutional amendment, had issued notices to attorney general for Pakistan and advocate generals of the four provinces for February 12.
