ISLAMABAD - Lal Masjid cleric Maulana Abdul Azeez yesterday filed a petition in the Supreme Court to enforce Sharia laws in the country in accordance with the constitutional provisions.
Maulana Abdul Azeez filed the petition under Article 184 (3) of the Constitution, making president, the governors of all the four provinces, the federal law secretary and the Council of Islamic Ideology chairman.
He asked the apex court to direct the federal and provincial governments to take steps as required under the Constitution to regulate the lives of Muslims in accordance with the teachings and requirements of Islam as set out in the holy Quran and Sunnah
The petitioner stated that Pakistan was founded on ideological basis and not on territorial grounds.
He said the very reason and object of the creation of this country was reflected in Article 2-A of the Constitution, commonly known as Objectives Resolution which inter alia states that Muslims shall be enabled to order their lives in individual and collective spheres in accordance with the teachings and requirements of Islam as set out in the Holy Quran and Sunnah.
He said the President and the governors, in respect of their jurisdictions, were bound constitutionally to get a report on observance and implementation of Principles of Policy prepared and submitted the same before respective legislatures.
Article 31 of the Constitution says: “The steps shall be taken to enable the Muslims of Pakistan, individually and collectively, to order their lives in accordance with the fundamental principles and basic concepts of Islam,” the petition states.
“Article 227 guarantees that all existing laws shall be brought in conformity with the injunctions of Islam as laid down in the holy Quran and Sunnah and no law shall be enacted repugnant to such injunctions,” it concluded.
