Court stays transfer of tehsil offices to I-8

Islamabad-Islamabad High Court yesterday maintained its stay orders against transfer of tehsil offices from district courts F-8 Markaz to I-8 Islamabad. A single bench of IHC comprising of Justice Aamer Farooq conducted hearing of the petition and maintained his previous stay orders issued on November 14.

Justice Aamer directed both the parties to resolve the issue with mutual consultation and inform the court about it on November 18, which is the next date of hearing of this matter.

Islamabad Bar Association had moved the petition challenging the transfer of tehsil offices from district courts F-8 Markaz to sector I-8 and cited Chief Commissioner Islamabad, Deputy Commissioner and others as respondents. During the hearing, Deputy Commissioner Islamabad, Col (Retd) Mushtaq and Director Administration Frasat Ali appeared before the court while Haroon Rashid and Tariq Mehmood Jehangiri represented Islamabad Bar Association (IBA). The DC Islamabad contended before the court that the administration took this step due to shortage of place in tehsil offices located in F-8 Markaz because people and staffers were facing severe problems. He added in this regard, they had also conducted consultations with some lawyers because there is no place even to keep the record.   He continued that computerization of record was not possible due to shortage of place. Mushtaq informed the court that it was finalized with the lawyers that despite the transfer of tehsil offices, the court proceedings will be held at district courts F-8 Markaz.

At this, the office-bearers of IBA told the court that they were not consulted in this matter. They said that sub-registrar office has already been transferred and lawyers and litigants are facing severe problems due to transfer of this office.

Later, court directed both the parties to resolve this issue with mutual consent and inform the court on November 18.
