Transfer of 49 CDA wings to IMC challenged

Islamabad - The employees of Capital Development Authority (CDA) yesterday moved the Islamabad High Court challenging transfer of 49 wings of the civic body to Islamabad Metropolitan Corporation (IMC).

The petition was moved by a section officer of the CDA and two others and they prayed to the court to annul the notifications dated 22 and 27 June, 2016 through which this transfer of power has taken place.  The petitioners including Azhar Khan, Muhammad Nisar Akhtar and Syed Munawar Ali Shah nominated secretary ministry of law & justice, ministry of capital administration and development division (CADD), ministry of interior, IMC, chairman CDA and director general CDA as respondents.

In their petition, they argued that these notifications were issued without going into the law laid down in CDA ordinance. They adopted that it is the federal government which, in case if the authority is dissolved, shall issue a notification and the assets shall be transferred to the federal government. But the respondents illegally and unlawfully issued notifications so much so that through a single letter all the powers entrusted to CDA have been transferred to IMC. They added that petitioners are government functionaries and these notifications were against their fundamental rights. The petitioners contended that the IMC has been harassing employees of the CDA.

 and it has also trespassed CDA offices.

Therefore, the petitioners prayed to the court not only to set aside the notification but also to bar the IMC from interfering in CDA’s internal affairs and harassing its employees.
