ISLAMABAD  - Supreme Court has set aside Election Tribunal decision and restored membership of Zia ur Rehman, PML-N MPA from PK-54 Mansehra.
Election Tribunal had suspended the membership of Zia ur Rehman from KPK Assembly in fake degree case.
A three-member Supreme Court bench presided over by the Chief Justice Tassaduq Hussain Jillani heard the fake degree case on Monday.
Counsel for Zia ur Rehman told the court his client belonged to PML-N and his membership of Assembly was suspended on fake degree basis while his degree was not fake.
The problem was that he had contested election on the basis of a sanad issued by Madrassah, he said.
Election Commission had not only accepted his nomination papers at that time but also the commission had allowed him to participate in the election, he argued.
On the other hand Election Tribunal had suspended his membership even after seeing all the evidence, he added.
He prayed to court to restore membership of assembly in respect of his client.
