Missing person not in custody, High Court told

KARACHI - Sindh High Court on Thursday adjourned the hearing on petition seeking the whereabouts of abducted person Munir Shakir to date in office. The statements were submitted before the division bench of High Court comprising Justice Mushir Alam and Justice Mohammad Athar Saeed, on the behalf of the federal government, provincial government as well as the law enforcement and other intelligence agencies, which informed that the person named Munir Shakir was not in their custody. Meanwhile, none of the representatives appeared before the court on behalf of the petitioner, while due to the absence of the counsel the court directed the petitioner to ensure his counsels presentation in the court in the next date, other wise the case would be dismissed. The petitioner Rehmat Khan moved a constitutional petition by submitted that his friend Munnir Shakir was abducted by the intelligence agency on 16 May, 2006 from Karachi Air Port when he arrived here. The petitioner made respondents of the federal and provincial government as well as the higher officials of the law enforcements and intelligently agencies. Guttar Bagicha case: Court issues directives Single bench of Singh High Court comprising Justice Maqbool Baqar directed the higher authorities for the implementation pertaining stay-order against any construction at Guttar Bagicha Park in Site Town, while adjourned the hearing over the contempt of courts application till 2 October. Barrister Naeem-ur-Rehman while counselling on the behalf of the petitioner Shehri an NGO, by arguing that on October 31 2008, the high court had granted the stay-order against any construction at the land of Guttur Bagicha Park, but the respondents violating the courts order resumed their construction works there. The plaintiff filed the contempt of courts application by submitting that the 480 acres of land of Guttar Bagicha located in old Golimar, Site town, is occupied by City District Government Karachi (CDGK) that allocated the land for K.M.C. Officers Cooperative Housing Society, as well as the other mafias started grabbing the land. The petitioner made respondents to Sindh Government local department, CDGK, Chief Controller of Building of K.B.C.A, K.M.C. Officers Co-operative Housing Society Limited and others. They submitted that the defunct KMC present CDGK wants to occupy the land in the name of its housing society. Plaintiffs pleaded to vacate the land of Bagicha as the land is the property of park, while the land was allocated to construct the biggest park in the country.
