LHC terminates lower court judges for misconduct

LAHORE - The Lahore High Court yesterday terminated an additional district and sessions judge after he was found guilty of misconduct, indiscipline and insubordination during the service.

According to a notification issued by the Lahore High Court, Justice Amin-ud-din Khan of the LHC afforded personal hearing to Mr. Hafeez-ur Rasheed, who was previously serving as additional district and sessions judge, D.G Khan, and recommended that it is a fit case to proceed under Section 10 of Punjab Civil Servants Act, 1974.

After considering record of the proceedings, his representation and note of personal hearing afforded to him, the LHC found the officer guilty of the above said allegations and terminated his services.

Plea against MQM leader dismissed

The Lahore High Court yesterday dismissed a petition seeking directions MQM leader Farooq Sattar to file affidavit before the court that it did not have contact with Altaf Hussain in the UK.

Chief Justice Syed Mansoor Ali Shah passed the order and held that it was not maintained. Abdul Majeed advocate had filed the petition and alleged that  Farooq Sattar also made anti Pakistan speeches and after being arrested by Rangers he announced disassociation of the MQM Pakistan from its founder Altaf Hussain. He stated it seemed as if he was cheating the armed forces and the public of Pakistan by making this announcement of disassociation. He said to save their skin they had made this announcement and after coming out of the current operation, they again would be united.

He submitted that if Sattar was speaking truth, he should say it on oath and file an affidavit in this regard before the court. However, the CJ observed that this petition was not maintainable as such directions cannot be issued to any person.

In another case, the LHC  disposed of a petition seeking directions for the federal government to block website of “India Today” for publishing derogatory picture of army chief Gen Raheel Sharif.  Chief Justice Syed Mansoor Ali Shah took up the petition and observed that the petitioner should approach the relevant forum.

Verdict reserved on Humaira’s plea

A sessions court yesterday reserved decision on an application moved by famous singer Humaira Arshad requesting recovery of her son from her former husband Ahmad Butt’s custody.

Ahmad Butt on the directions of the court submitted his reply saying that the allegations of Humaira Arshad leveled against him were baseless; he never tortured her. He said that an application regarding the custody of minor child was already pending with a Guardian court but she filed a new application before this court.

He said that she cannot file any other application regarding the same matter till the previous application was decided by the relevant court. Humaira Arshad through her counsel stated that Ahmad Butt used to torture her. She said he took her son along with her while a mother can better take care of her son.

She apprehended that Ahmed Butt might fly abroad along with her son. She requested the court to order police for recovery of her son from the alleged illegal custody of her former husband. After hearing both sides, additional district and sessions judge Ghulam Abbas reserved the verdict for September 5.

Meanwhile, the Lahore High Court disposed of a petition of a woman seeking custody of children with directions to the separate parents of the children to approach the guardian court.

Nazish, a resident of Jaranwala district, had filed the suit for recovery her children from the custody of her first husband. She pleaded the court to order her former husband Shahid Iqbal to give her children into her custody.

At this, Shahid Iqbal told the judge that she had taken divorce from her second husband and was willing to marry third one. She was found of polygamy and he cannot leave his children suffer with such woman. After hearing both sides, Justice Erum Sajjad Gul of the LHC disposed of the petition and directed the petitioner to approach the guardian court.
