LAHORE - Lahore High Court on Tuesday sought ‘sensitive reports’ about Jamatud Dawa leader Zakiur Rehman Lakhvi, accused of mastermind of 2008 Mumbai attacks, in a petition filed against his detention.
The counsel of Zakiur Rehman Lakhvi contended the detention order issued by the DCO Okara was contempt of the verdict issued by the IHC. He said the IHC had set aside third time detention of petitioner and had ordered the authorities to release Zaki Lakhvi immediately.
According to his counsel, before the petitioner release, the DCO Okara on March 14 issued a fresh detention order against Lakhvi, when in his previously case, he was also granted bail.
The counsel argued the LHC on March 26 had directed the home secretary to decide his request against detention. He said the department had turned down his request, which was illegal.
Now the department had not authority to detain a person for forth time without presenting him before LHC review board, he added.
Lakhvi’s counsel further said the government was legally bound to produce the petitioner before review board, which was the only forum to decide the detention matter.
He requested to declare the detention order as illegal and unconstitutional.
Lakhvi had earlier filed a petition challenging his detention and LHC on March 20 had dismissed his petition with directions to seek the available remedy before coming to the LHC.
The judge adjourned next hearing on April 9 (Thursday).
Another plea FILED against
presidential ordinance
Another petition against the presidential ordinance for formation of a judicial commission to probe into alleged rigging in 2013 general elections was filed in the Lahore High Court on Tuesday.
Advocate Ch Shoaib Saleem filed the petition submitting that the formation of the said commission was against the Article 225 of the constitution. He said law enforcing agencies had the powers to hold inquiry into such matters and not the judicial commissions.
“Article 89 of the constitution requires particular circumstances for the formation of the commission which are not there and later created by two private persons (two political parties: PML-N and PTI) by signing an agreement in this regard a few days back,” the petitioner said. He said that such commissions and inquiry tribunals were made to waste the time of the judges and courts. He prayed to the court to set aside the said ordinance.
LHC bench seeks Record of cases against Khawaja Saad Rafique
A division bench of Lahore High Court directed Lohari Police Station SHO to produce record of cases registered against Railways Minister Khawaja Saad Rafique in 2004.
Lohari Gate police had lodged FIR against Railways Minister Khawaja Saad Rafique for holding marches and rallies against former military ruler Pervez Musharraf and attacking police in 2004. He was also booked under 7ATA and other sections of PPC.
An Anti-Terrorism Court had already declared him as proclaimed offender for not appearing in the court in the said case. The court will resume hearing on April 14.
