Court directs PA Speaker to forward reference to EC

LAHORE - The Lahore High Court on Tuesday issued notice to the speaker Punjab Assembly on a petition seeking directions to the speaker to forward disqualification reference against PML-Q MPA Saba Sadiq to the chief election commissioner for defecting the party. As the proceedings started on Tuesday, the petitioner's counsel Fawad Chaudhry pointed out that the speaker is not impartial rather favouring ruling PML-N. He also criticised the court that the delay in court's proceedings had also helped ruling party as it had formed a forward bloc in PML-Q and their game plan is to bring enough people in to replace the opposition leader. Criticism on court irked the judge who angrily asked Fawad, you must respect the decorum of the court. You are blaming court for delay in the case, but neither you deposited process fee nor appeared before the court on previous hearing on Monday. If you don't have confidence in court, I will refer the matter to the chief justice. The counsel, however, remained unmoved and did not seek apology. The judge then continued to proceed further. The petition was filed by opposition leader in Punjab Assembly Ch Zaheer-ud-Din through his counsel Fawad Chaudhry. AGP Khawaja Haris in his arguments stated that the petitioner should have removed the objections put by the speaker on his reference instead of seeking interference of the court. He further said that the speaker Punjab Assembly had filed his written reply to the extent of petitioner's case, however, the court could not seek reply from the speaker on proposed objections on the reference anticipated by the petitioner. It may be recalled that previously the court had directed the secretary Punjab Assembly to disclose before the court in writing all the awaiting objections on disqualification reference against MPA Saba Sadiq. Adjourning the hearing for today (Tuesday) Justice Umar Ata Bandial directed the petitioner's counsel to file his rejoinder in light of the reply submitted by the speaker. The matter of PML-Q MPA Saba Sadiq's disqualification landed in the LHC after the speaker PA declined to send reference to CEC on some technical grounds. Leader of opposition in Punjab Assembly Ch Zaheer-ud-Din had filed the petition, seeking adherence to constitutional provisions that would lead to MPA's disqualification on account of defecting the party. Earlier Justice Umar Ata Bandial had disposed of the same petition while directing the petitioner to file reference again before the speaker after removing the objection for which the same was not forwarded to the election commission. The judge had also directed the speaker Punjab assembly to proceed on the petitioner's recommendations according to law. Now the petitioner has filed a fresh petition submitting that in the light of court's earlier directions, the reference against MPA Saba Sadiq was filed before the speaker but the same was forwarded to the election commission.
