Court allows appeals of Sharif family
 
 
 

Lahore - A ‘referee judge’ of the Lahore High Court on Tuesday allowed appeals of Sharif family challenging two references filed by National Accountability Bureau (NAB) against Hudebiya Papers Mills and others.
Justice Sardar Muhammad Shamim Khan was hearing the appeals as referee judge after Justice Sheikh Najamul Hassan refused to proceed further with the matter.
A division bench comprising Justice Khwaja Imtiaz Ahmad and Justice Farrukh Irfan Khan at Rawalpindi bench heard appeals and differed on the point whether there was no need or requirement that NAB authorities were competent to proceed against the petitioners if investigation was again initiated.
Chief Justice Umar Ata Bandial had initially appointed Justice Hassan as ‘referee judge’ after a division bench hearing the appeals of Sharif family came to a dissenting observation on a law point.
Later the Chief Justice assigned the role of referee judge to Justice Khan after Justice Hassan declined to further hear the appeals owing to personal reasons.
Advocate Ashtar Ausaf represented the Sharif family before the referee judge and contended that the NAB had made the references on direction of then military ruler Musharraf to victimize the Sharif family.
He said the references could not be reopened. Justice Khan admitted the arguments and allowed the appeals.

TO SUBMIT REPLY
The Lahore High Court on Tuesday directed Ministry of Defence to submit reply over a petition requesting recovery of an alleged missing Major (Retd) Mujahid Azeem Tariq and his son Ali Tariq.
Naeema Tariq, the wife of kidnapped retired Major, had filed a petition for recovery of her husband Tariq and son Ali submitting that her husband was missing for the last three months. She said when she approached the court her son Ali Tariq also went missing.  She said police and other security agencies failed to recover both father and the son despite that three months had gone.  Petitioner pleaded the court to issue directions to police and other security agencies to recover both the missing persons.
In this case, Military Intelligence and Intelligence Bureau had already denied custody of the alleged missing retired Major and his son.
