Court serves notice on Chief Secy for Jan 19

LAHORE - A writ petition has been filed in the Lahore High Court challenging the orders passed by the revenue authorities, whereby a 141 years old entry in the revenue record has been changed. The petitioners contended that the entry had been made in the records prepared during the settlement operations conducted in Kasur in 1868 and had been effected with the consent of the ancestors of the parties. It is further alleged that the Chief Secretary Punjab is one of the beneficiaries of the change in the revenue record. It is claimed in the petition that the predecessors in interest of the parties did not question the entry for about a hundred years, which continued to appear in the revenue records prepared subsequently. In fact, it is contended, the ancestors of the parties accepted that entry as correct, and acted upon it by claiming further rights on the basis of the shares stated therein. The petitioners claimed that the revenue authorities have no jurisdiction to change such long-standing entries in the settlement records. The petitioners further alleged that pursuant to the orders of the revenue authorities, a mutation has been attested in favour of the contesting respondents. It alleged that this mutation was prepared on the basis of an application moved on the same day on which the order of the Board of Revenue was passed - on January 3, 2009, and the EDOR, DDOR, tehsildar and patwari processed that application and prepared the mutation on that very day. This happened despite the fact that the written order of the Board of Revenue was not available till at least 7:00 pm on January 3, 2009. Petitioners contended that this has been done under the influence of the Chief Secretary Punjab, who is a direct beneficiary of the mutation. After hearing preliminary arguments on the matter, Justice Ali Akbar Qureshi issued notice to the respondents in the petition, including the Chief Secretary Punjab. The case was adjourned to January 19 for arguments.
