Notice to ECP, Kh Hassan

LAHORE - The Lahore High Court yesterday issued notice to Election Commission of Pakistan and other authorities to submit replies in a petition challenging eligibility of Khwaja Ahmad Hassan of PML-N for holding chairmanship of Union Council-107.
Justice Shahid Karim of the LHC heard the petition filed by PTI leader Zubair Khan Niazi and adjourned further hearing until March 31.
The petitioners’ counsel Advocate Sheraz Zaka argued that Khwaja Ahmad Hassan held different positions with different public departments including Lahore Development Authority, Lahore Transport Company and Lahore Waste Management Company.
He argued that according to Section 27 of Local Government Act 2013, a person who had held an office of a statutory body controlled by a provincial government was not eligible to contest election of local bodies before two years’ elapse.
The counsel said the respondent resigned from the offices days before filing of nomination papers for LG polls.
Therefore, Hassan, who was likely mayor of Lahore, failed to meet the two year bar, he added. The counsel prayed to the court to declare the respondent disqualified to hold the office of the chairman.
