LAHORE – When the Prime Minister was announcing on Saturday judicial probe into the air tragedy, the Lahore High Court Chief Justice said the recommendations of judicial body had never been implemented.
Chief Justice Sheikh Azmat Saeed expressed these views while addressing a gathering of additional session judges who recently completed course at Punjab judicial academy.
He lamented that people were already disturbed with the Siachen incident and the plane crash added to their woes.
He said judicial commission would be asked to form but its recommendations would never be implemented.
“Government issues directives to form judicial commission under public pressure but never implements its recommendations; therefore, it is wastage of time. Every question will be answered if government has the courage to take action on the recommendations,” he cleared the position of judiciary. Some judges have already opposed the constitution of commissions on national issues on government’s request after the viewing the fate of earlier recommendations of the judicial bodies.
Talking about the training courses for additional district sessions judges, the chief justice said heavy investment was being done on the holding of these refresher courses in terms of time and money and stressed upon the course participants to make full use of this exercise and deliver in the present circumstances and available infrastructure.
He said results of these capacity building courses should be result oriented and there would be no compromise on the quality and quantity of judgments. The chief justice was of the view that improvement of judicial system in the Punjab was of paramount importance for improving whole judicial structure of Pakistan because 84 % of the litigation belonged to Punjab.
He said they (judges) could not dream of rule of law in the country without following the principles and law of the land.
For building confidence among the people, he said, it was prerequisite that masses should be confident that every accused would get punishment as per law. The chief justice advised the participant judges not to go for merely number game by disposing more cases rather they should decide cases on the basis of sound evidence and according to constitution/law. He also disliked the blatant use of discretionary powers as law does not permit use of these powers at will.
The chief justice also distributed certificates amongst the course participants who include Shahzad Hussain, Muhammad Iqbal, Bashir Ahmad Chaudhary , Sadiq Masood Sabir, Zafar Iqbal Tarar, Mrs. Misbah Khan, Shahid Sikandar, Rana Zahid Iqbal, Muhammad Ashiq, Ghulam Abbas, Muhammad Afzal Khan, Arif Mehmood Khan, Muhammad Amir Habib, Muhammad Zahid Ghaznavi, Muhammad Nadeem Shaukat, Naeem Ahmad, Rai Muhammad Nawaz, Muhammad Arif Hameed Shiekh, Muhammad Aslam Gondal, Muhammad Ijaz-ur-Rehman, Sohail Shafiq, Muhammad Ramzan, Muhammad Naeem Sheikh, Qamar-ul-Zaman, Muhammad Kaleem Khan, Asim Mansoor, Muhammad Yaseen Shaheen and Umar Hayat.
