LHC seeks info on Pak-US drone pact

LAHORE - Lahore High Court Chief Justice Umar Ata Bandial on Friday said the federal government had failed to protect the lives and properties of the citizens.The chief justice remarked this while seeking reply from the government that whether killings of innocent citizens including children and women in US drone attacks was not a violation of fundamental rights of people of Pakistan in constitution.The court also sought reply whether such strikes were being made with the permission of government and what steps had been taken to stop the killings innocents in these attacks. The court further directed the federal government to submit agreement, if any, between Pakistan and United Stated of America (USA) on the drone attacks.The court is holding proceedings on a petition moved by Jamatud Dawa (JuD) chief Hafiz Muhammad Saeed US drone strikes in Pakistan.Advancing arguments, JuD chief’s counsel A.K Doggar said protecting the lives and properties of the citizens of Pakistan was a prime responsibility of the government.If the state was involved in murdering its own citizens after joining hands with another country, it was duty of judiciary to ask government that why was it not performing its constitutional duties, the counsel pointed out. Citing Supreme Court’s judgment in Balochistan’s law and order case, the counsel argued the court had declared provincial government had no right to rule.The court adjourned further hearing till March 07.Hafiz Muhammad Saeed had sought directions to the federal government to make public information in all matters of public importance, especially the secret ‘deals’ with US in implementation of article 19-A of the constitution which entitles every citizen of Pakistan to have access of all information. He asked the court to declare that the pre-emptive strikes by foreign countries were not permitted by international laws, therefore, every man, woman and child have a right to claim to be protected and a direction in the nature of mandamus may be issued to the government.
