LHC orders Tevta contract employees' regularisation

LAHORE-The Lahore High Court has imposed Rs 50,000 penalties on the Secretary TEVTA for not complying with Punjab governments policy of regularizing the TEVTAs contract employees. The court also ordered Secretary TEVTA to regularize all the contract employees of TEVTA immediately. The Secretary TEVTA is order to pay the penalty from his own pocket and the same will be deposited in the Dispensary of High Court Bar Association, Multan. This was ordered in a detailed judgment of Lahore High Court Multan Bench on the petition of contract employees of TEVTA. The petitioner contended that Chief Minister of Punjab directed that all the autonomous/semi autonomous bodies/special institutions in the Punjab shall make appointments on regular basis of contract employees in BS-1 TO BS-15. He submitted that the services of most of the employees and other provisional department, who were working on contract basis like education, health, agriculture department were regularized on the basis of their own pay and scale. However, Technical Education Department (TEVTA) did not regularize the services of its employees who are on contract. The court observed that according to Article 25 of the Constitution by not regularizing the TEVTA contract employees, the TEVETA administration made discrimination as all the employees placed in similar position are equal in the eyes of law. The TEVTA administration in its reply said that as the contract employees of Technical Education and Vocational Training Authority (TEVTA) had been appointed under its own recruitment policy, the notification of the Government was not applicable to such employees. The court has observed that as the Punjab Government has been regularizing the services of the Autonomous and semi Autonomous bodies so that under Article 25 of the Constitution of Islamic Republic of Pakistan, all the citizens are equal in the eyes of law, this article of the Constitution does not permit the discrimination. TEVTA is created under the Punjab Technical Education & Vocational Training Authority Ordinance 1999; it does not mean that the TEVTA is out of the jurisdiction of government of Punjab. The employees of the TEVTA are government employees in government service although covered under Punjab Technical Education & department institution are handled by the TEVTA. Further the court observed that as the annual budget of TEVTA is sectioned by the government of Punjab. Hence all the employees of TEVTA should also be treated equal to employees of the other Autonomous and semi Autonomous institution in the province of Punjab. Their services should also be regularised as constitution does not permit the discrimination. medics team starts working at Hunza A fresh medical team sent by the Punjab government for providing medical assistance to Attabad Lake affectees has started to provide medical treatment to the patients after its arrival in Hunza. This was informed by the incharge medical team Additional Director Health Dr Mubasher Malik on telephone on Thursday. He said that responsibilities of the areas of OST, Nagar, Ganish Camp and Aliabad have been assigned to the team of doctors from Mayo Hospital. Similarly, responsibilities of Gulmat, Minapan, Fikr, Altat, Baltit camps have also been assigned to the medical team doctors from Allied Hospital Faisalabad. He further stated that despite all climatic problems and difficult terrain, doctors were providing healthcare facilities to the patients and as many as 2,618 patients had so far been treated during the last three days besides providing them with free of cost medicines.
