plea rejected: The Lahore High Court yesterday rejected a writ petition against execution of a ‘paralyzed’ condemned prisoner Abdul Basit.
Mother of the convict, Nusrat Parveen, challenged death warrants of her son issued by a sessions court of Faisalabad. Basit, 43, was convicted and sentenced to death for killing one Asif Nadeem of Okara murder in 2009.
The petitioner’s counsel stated that the execution of a paralyzed man was against the jail law and human rights. He said being in healthy condition was necessary for a convict to be executed.
He said Basit was paralyzed from the waist down due to negligence of jail officials and used a wheelchair to move. He pointed out that previously hanging of the convict was delayed by a judicial magistrate, who was in jail to monitor the execution. He said the magistrate had written a letter to interior ministry seeking assistance on law about hanging disabled convicts. However, he said, the letter was never answered.
He prayed to the court to set aside the death warrants issued by the trial court and stop the execution of Abdul Basit.
An official of Faisalabad jail told the court that all appeals of the convict had been rejected while Supreme Court also upheld the conviction. He submitted that his appeal was not maintainable. After hearing both sides, the court dismissed the petition.
