ISLAMABAD - The Supreme Court on Tuesday issued notices to respondents including Interior Minister Rehman Malik, former law minister Dr Babar Awan, PML-Q leader Pervaiz Elahi and others, allegedly involved in Benazir Bhutto murder case, to file para-wise comments, if they so desire, within a period of two weeks and said it would constitute a larger bench to look into registration of second FIR in the matter. The Chief Justice Iftikhar Muhammad Chaudhry also ordered the special judge of Anti-Terrorism Court, seized of the matter of Benazir Bhutto’s murder, to submit copies of the proceedings along with order sheets and progress so far made in the case in the next hearing.A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Khilji Arif Hussain and Justice Tariq Pervaiz heard the case.Advocate Chaudhry Aslam, former Chief Protocol Officer of Benazir Bhutto, has filed a petition in the apex court seeking registration of another FIR in Benazir assassination case. He prayed that the first FIR submitted in the case did not mention the names of the ‘real culprits’. Chaudhry Aslam in his application has pleaded to include the names of General (r) Pervez Musharraf, Rehman Malik, Babar Awan, Pervaiz Elahi, former interior minister Hamid Nawaz, former DG Intelligence Bureau Ejaz Shah, former interior secretary Kamal Shah, Brig (r) Javed Cheema, former DCO Rawalpindi Irfan Ilahi, ex-CPO Rawalpindi Saud Aziz and SP Rawal Town Khurram Shahzad.During the proceedings, the Chief Justice said that the President in its speech has asked for taking suo moto notice in the matter. The Chief Justice said a petition has already been submitted in this regard in the Supreme Court and they would hear it in any circumstances. He said this case was serious in nature and the people wanted to know the truth behind Benazir Bhutto’s assassination.President Zardari, while delivering a speech on the fourth death anniversary of late Benazir Bhutto at Garhi Khuda Buksh, said: ‘Chief Sahab (CJP) I ask you what had happened to the killers of Benazir Bhutto’.During the hearing, the Chief Justice asked the Attorney General whether he was satisfied with the progress of the investigation. The court asked Attorney General Maulvi Anwarul Haq to take directives from the government in this regard. He said a tribunal comprising senior officials from all the provinces could be formed to probe the Benazir murder.The AG said there was no problem in the case so far, and the investigations were being carried out. He also specified three different investigations including the Scotland Yard, a United Nations Commission’s report and a joint investigation team.In reply to which, the Chief Justice said that the UN Commission’s report was civil in nature, not criminal. He said it was the task of the government to take clues from it and carry out an independent investigation.The court observed that it was compulsory to have an independent investigation body.Justice Tariq Pervaiz inquired from the AG whether any family member of Benazir Bhutto has registered an FIR. The AG replied that none of them was in Pakistan. He said the FIR has been registered against Pervez Musharraf and others.Advocate Chaudhry Amjad Iqbal submitted an affidavit on behalf of the two alleged suspects in the case, Javed Iqbal Cheema and Kamal Shah, and said his clients did not have any involvement in the case.The hearing was adjourned for two weeks.
