ISLAMABAD  - Supreme Court while maintaining the stay order against the Sindh Peoples Local Government Ordinance (SPLGO), 2012 on Friday directed Fateh Malik, Advocate General Sindh (AGS) to start his arguments in next hearing.
A three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Gulzar Ahmed and Justice Sh. Azmat Saeed continued hearing on the case of SPLGO, 2012.
During the hearing, the Chief Justice said that after this Ordinance, the Sindh government role would be curtailed and it would have to seek compliance of the
Local Government for the implementation of its orders.
The CJ maintained that the provincial government has yet to implement the Supreme Court decision in Karachi law and order situation, then how it would implement on Local Government Ordinance.
He said that the law is not a thing to be placed in the shelves; it is made to give relief and welfare to the public.
The Chief Justice was of the view that under this Ordinance, the provincial government role will be squeezed to monitoring only and no practical involvement could be made in the affairs.
Mian Abdul Raoof, member of Sanghar Bar Association termed the Sindh People’s Ordinance as discrimination in the fundamental rights of the citizens living in the different parts of the province.
He said that the law does not give anyone the right of such discrimination with the citizens.
Upon which the bench directed Abdul Raoof to submit his stance in written on the formation of the Ordinance.
Anwar Mansoor Khan, the counsel of the Sindh government also completed his arguments.
Later, the court maintained the stay order and adjourned hearing till February 11th.
