DG FIA, others directed to submit comments

ISLAMABAD - The Supreme Court directed the respondents to submit para wise comments on the petition against the misappropriation, misuse and embezzlement of welfare fund for National Banks staff by the high ups. A three-member bench, headed by Chief Justice of Pakistan Iftikhar Muhammad Chaudhry and comprising Justice Muhammad Sair Ali and Justice Ghulam Rabbani admitted the petition for regular hearing, filed by Sayed Jahgir, Secretary General Trade Union Foundation, National Bank of Pakistan. The petitioner made Secretary Ministry of Finance, Director General FIA, Director FIA Sindh, Saifullah Jokhio Assistant Director FIA and Inspector Saeed Ahmed Memon as respondents in his petition. The petitioner prayed the court to recover the looted amount of over Rs2 billions from the high ups of the National Bank and asked the FIA to take stern action against the culprits in accordance with the law. He questioned that whether billions of rupees of proposed trust under the name and style of welfare fund for banks staff can be distributed without formation of board of trustees and rules made by competent authority. He stated that funds collected from the gross profit of national commercial banks had disbursed in the name of scheme of achievement award in the banks high ups. According to the petition, enquiry was registered in commercial bank circle zone Sindh on April29, 2009 on the source report of Saifullah Jokhio Assistant Director FIA, who had exposed that approximately Rs600 million in the name of achievement awards from welfare staff fund was distributed among banks high ups illegally. The petitioner also informed the names of those 14 executives who had received huge amount in achievement award from 2003-2008 unlawfully. He said that the culprits were not only linked with the top slot of the country but so influential that they got the registration of case pending in spite of the permission granted by DG FIA. The petitioner pleaded that this is the case of public importance as the money of stakeholders is misappropriated in the grab of welfare fund for banks staff thus attracts the original constitutional jurisdiction of the apex court. The court adjourned the hearing till June 8.
