Islamabad: Justice Asif Saeed Khosa has stated, “The real custodians of the constitution are those whom people elect and send to parliament and it will be wrong to say that only we are custodian of constitution.”
He further remarked that if elected representatives make amendment as per aspirations of people then they can be elected again.
Chief Justice of Pakistan (CJP) Nasir ul Mulk said, “What are the basic features of the constitution.? If the basic structure of the constitution is in place then how can the amendment be made therein?”
Justice Mian Saqib Nisar said that he has been enjoying the debate going on in TV channels on the constitution since the last two days. He said that such people are participating in the debate who know nothing about the constitution.
Justice Sarmad Jalal Usmani remarked that the court is the custodian of the constitution, “How can we reject any decision which is given by majority,” he added.
A 17-member full bench of Supreme Court (SC) presided over by CJP Nasir ul Mulk took up for hearing the petitions filed against 18th and 21st constitutional amendments today.
Hamid Khan, counsel for Sanghar Bar Association, argued while discussing the role of the parliamentary committee in the appointment of judges that no amendment can be made in the basic structure of the constitution.He added that the Indian constitution also banks on this structure. He said that there should be no role for parliamentary committee in the appointment of judges.
