Ex-CJP questions PTI's existence in Parliament

Islamabad- Former Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry in a letter sent to speaker National Assembly (NA), has called for immediate acceptance of resignations from PTI members of assembly saying, “Under what capacity PTI members of assembly are sitting in parliament.”

Former CJP in his letter said, PTI members of assembly had sent their resignations to speaker NA, but breach of constitution was committed by not accepting them. Any assembly member, who abstains from assembly for 40 days, loses his seat automatically under clause No 1 and 2 of article 74 of the constitution.

The letter further said speaker NA has taken an illegal step, by not accepting the resignations of PTI members of NA. It was responsibility of speaker to accept these resignations and make it binding on Election Commission (EC), to hold by polls on vacant seats

Letter further stated that PTI members of NA have sent their resignations on their own. They have now lost legal status in parliament, after offering resignations. How did they come to parliament? PTI members of assembly are no more part of the parliament under article 164 of the constitution.

Former CJP while addressing speaker NA further said in his letter “under what capacity PTI members of assembly are sitting in parliament. Their resignations should be accepted immediately. I am making this request to you as a common citizen, to play your constitutional role on this matter.”
