SHC asks respondents to submit comments

Our Staff Reporter KARACHI - Sindh High Court on Tuesday summoned transport ministry, transporters bodies and other respondents and directed them to submit their comments over increasing of intercity and local transportation fares in the next hearing to be fixed later. Hearing a constitutional petition, a division bench consisted of Chief Justice Mushir Alam and Justice Salman Hamid issued directives to the respondents to submit their explanations before the court. Rana Fiaz-ul-Hassan seeking to set aside the order regarding increase in transport fares filed the petition. He submitted that the intercity and local transporters have increased the fares illegally after increasing the oil prices, he added that the poor people prefer to use public transport facilities, as they are not able to afford privet transports for travel, but the recent decision to fix new transport fares have affected the people brutally across the province. Accusing the transporters and their representative bodies, he maintained that they have their own monopoly while increasing the fares without having approval from the transports regularity body. However, some concern government officials have being providing patronage to such transport mafia he claimed. He termed that the transporters have not only violated the Traffic Law 1965 but also challenged the writ of the government while increasing the fares while bypassing the governments directive and sustained their domination. The plaintiff stated that the transporters violating the constitutional of article (8) while violating the basic human rights for creating more and more difficulties and hurdles for the people as depriving them from their basic rights of cheap transport facilities. The petitioner submitted that Regional Transport Authority Sindh remained ineffective as it was not able to make implement its decision affectively. He added that the provincial government had constituted the said regularity authority not for only fixing of travelling fares but also to resolve difficulty of the transporters, but it failed to do so. He also declared the motorway police as ineffective as they have never taken stern action against the transporters to violate the laws. Chief Secretary Sindh, Sindh Transport Secretary, Regional Transport Authority, In-charge of Motorway Police Sindh, President Karachi Transport Ittihad, head of Sindh Air-condition Coaches Association and DIG Traffic were cited as respondents. The petitioner pleaded that the Sindh Transport Minister and Secretary Transport be issued order to restrain the inter-city and local transporters to increase the fares illegally. It was also prayed to end their monopoly anymore and bound the transporters to implement the laws.
