SC rejects former CJP's petition for issuance of stay order

ISLAMABAD: Supreme Court (SC) has rejected former Chief Justice of Pakistan (CJP) Abdul Hamid Dogar petition seeking stay order against hearing of the case by special court.

The court remarked “we cannot issue stay order on mere the grounds of harassing you. No one has arrested you.

The court while issuing notice to Attorney General (AG) has sought reply from him. A 3-member bench of SC presided over by Justice Mian Saqib Nisar took up the case for hearing Tuesday.

Iftikhar Gillani advocate appeared on behalf of former CJP Abdul Hamid Dogar and took the plea that his client was being harassed. Trial court was not entitled to issue any order for declaring him co-accused in treason case against former president Pervez Musharraf. His client has nothing to do with November 3, 2007 emergency proclamation related matters nor has he any connection with administration matters being CJP. The verdict given by 14-member larger bench of SC is only against former president Pervez Musharraf. Therefore, proceedings initiated against his client are based on mollified intent and subordinate court cannot issue such orders.

He prayed that this case has assumed much significance, therefore, the special court be restrained from functioning and decision given by Islamabad High Court be declared null and void.

Justice Mian Saqib Nisar remarked “you are being harassed only. No one has arrested you; therefore, stay order cannot be given.

The hearing of the case was adjourned indefinitely.
