ISLAMABAD- Supreme Court (SC) will decide today about the petitions filed therein seeking disqualification of Prime Minister (PM) Nawaz Sharif.
A full bench of SC presided over by Justice Jawwad S Khawaja adjournedthe court till Thursday on the hearing of the petitions filed by IshaqKhakwani from PTI and Chaudhry Shujaat Hussain from PML-Q observing that petitioners job is to file cases and court’s job is to give decision. Decisions are given in consonance with law and not as per will of petitioners.
Justice Jawwad S Khawaja remarked “this will be decided on Thursday if I have to sit in bench or otherwise.”
Commenting on Irfan Qadir’s application praying that Justice Jawwad S Khawaja should not hear this case, Justice QaziFaizEssa remarked “It cannot happen so that an objection is raised on any judge and we stop hearing the case.” He further remarked that “Chief Justice of Pakistan (CJP) has rejected this application.”
The learned counsel said CJP has rejected application from Gauhar Sindhu in connection with larger bench. Registrar office had raised objections over the petition filed for recusal and now appeal has been filed against the objections.
Justice JawwadS Khawaja said to Irfan Qadir “you told us and we heard it. It is we who have to give decision. Petitioner wants a lot but the court does not give decision as per their whims.”
Irfan Qadir said it is case of public interest and national importanceand as it is a of first of its kind case therefore, a larger bench should hear it.
He further said that court had itself decided to bring the cases of Zulfiqar Ali Bhutto and Yusuf Raza Gilani under consideration of larger bench in view of their importance.
Justice Jawwad S Khawaja remarked “ if we are convinced that the matter is very important we can recommend to send it to larger bench.
