RAWALPINDI An accused, arrested along with four others in PPP former PM Benazir Bhutto (BB) murder case, has took back his bail plea Wednesday that was filed by him with Lahore High Court (LHC) Rawalpindi Bench some months ago. The bail plea, filed by the accused Sher Zaman, was taken up by LHC Divisional Bench comprised Justice Sardar Tariq Masood and Justice Khawaja Imtiaz Ahmed. However, Khurram Qureshi, the counsel for the accused, withdrew the bail plea after Federal Investigation Agency (FIA) prosecution argued that the bail plea could only be filed before the trial court. During the hearing, FIA Prosecutor Chaudhry Zufiqar told the court that Sher Zaman could not obtain post arrest bail on the ground that he was being kept in the jail without trial for the last three and half years. Chaudhry Zulfiqar argued that according to the law no one could be detained in jail without conducting trial for more than two year. The bail application of Sher Zaman was set aside by a trial court where the accused had not cited the reason of delay in trial. If Sher wanted to obtain bail on this ground than he should first approach the trial court, FIA prosecutor added. After the completion of the arguments, LHC Division Bench laid down the verdict that the matter would again be taken up after Eid-ul-Fitr. On this, the defence counsel said he wanted to withdraw the bail plea. Sher Zaman, the accused in BB assassination case, knocked the door of LHC Rawalpindi Bench on March 29 pleading that the authorities could not keep him in the jail with out conducting trial against him. The accused also added that another accused Aitzaz Shahs confessional statement was the only proof against him, however, Aitzaz Shah has also been declared as a juvenile which made his statement doubtful.
