Justice Fayyaz retires on June 1

ISLAMABAD - Justice Raja Fayyaz Ahmed, who remained steadfast with the Chief Justice Iftikhar Muhammad Chaudhry when the CJP and other judges of Supreme Court and High Courts were deposed as result of promulgation of Emergency on 3rd November 2007, is retiring on 1st June 2011. He was elevated as judge of the Supreme Court on 14th September 2005. Before that he was Chief Justice of the High Court of Balochistan. He joined High Court of Balochistan in January 1997 as a judge. He is among the seven-member bench that had passed the 3rd November 2007 restraining order against General (Retd) Pervez Musharrafs illegal steps. He stood unwavering with the Chief Justice Iftikhar Muhammad Chaudhry and other judges of the apex court till their restoration. Justice Fayyaz refused to take oath under the PCO and was put under house arrest like the chief justice and some other judges, along with his family. He also refused to take fresh oath by Justice (Retd) Abdul Hameed Dogar and was restored along with the Chief Justice of Pakistan Iftikhar Muhammad Chaudhry in March 2009. Justice Raja Fayyaz is known for his straight-forwardness, outspoken and boldness. He continuously was part of the bench, which heard the missing persons cases in the apex court. He also delivered a landmark order in the case of missing persons on January17, 2011. He is known as taking strong interest in human rights cases. He has been part of the benches, which passed judgments on important cases, including restoration of the CJP in 2007, National Reconciliation Ordinance (NRO), the 18th Amendment, Hajj corruption and many others. Justice Raja Fayyaz also sat in the 13-member bench, which had declared the November 3, 2007 PCO and emergency as unconstitutional on July 31, 2009. In October 2007, he was included in an 11-member bench of the SC to hear a petition filed by a presidential candidate, Justice (Retd) Wajihud Din Ahmad challenging the eligibility of Musharraf to contest the elections for the office of the president. On November 3, 2007, Musharraf imposed an emergency through a provisional constitutional order (PCO) in the country. It is relevant to mention that besides Justice Raja Fayyaz Ahmad four other judges of the Supreme Court will also retire this year, including Justice Javed Iqbal, on July 31, 2011, Justice Muhammad Sair Ali on December 11, 2011, Justice Mahmood Akhtar Shahid Siddiqui on October 13, 2011 and ad hoc judge Justice Ghulam Rabbani on October 19, 2011.
