Calling army in Islamabad is unlawful: Petition

ISLAMABAD- The government’s decision to call the army to aid with civil administration in Islamabad has been challenged in the Islamabad High Court (IHC).

The petitioner Shahid Orakzai has argued in his petition that in the absence of the Prime Minister, the federal cabinet is not entitled to give any advice to the President in respect of article 245 of the constitution; neither can the Prime Minister delegate this obligation to any federal minister under article 90 of the constitution.

The petition further stated no cabinet meeting can be held during the absence of the Prime Minister from the country, nor can the advice given to the President in the PM’s absence be considered cabinet advice under article 48 of the constitution.

Orakzai made it clear that calling in the army is a political act and there is no crisis like a law and order situation in the federal capital.
