Sacked KU employee moves SHC against removal

KARACHI - Former Chief Security Officer Karachi University, Muhammad Zahid Maqsood, has filed a petition against KU, challenging his removal order issued by the varsity as Chief Security Officer, TheNation has learnt. The KU vice chancellor, registrar, deputy registrar general and Senior Security Officer Syed Iftikhar Alam are cited as respondents in the petition. The petitioner has submitted that after he joined the KU as Chief Security Officer, he worked well. He due to his mothers serious illness proceeded on leave on emergent basis to take her care with due process of law and submitted applications for four days leave to his immediate officer i.e. the security advisor, where after he sent two more letters via TCS to inform the administration about his extended absence. Besides, the petitioner also informed the vice chancellor on telephone about his absence and the same fact was also brought to his notice by the immediate officer of the petitioner. The registrar on the basis of false information allegedly conveyed to him by security staff that the petitioner has not been attending office since November 16, 2010, advised the petitioner vide his letter/order dated November 23, 2010 to see the said respondent on November 26, 2010. The petitioner furnished his reply to the above explanation and denied the allegation of remaining absent without any intimation and/or application and stated the fact of his leaving the station on emergent basis on account of his mothers ailment who remained hospitalised for over 10 days in CMH Okara and Lahore. The office of the registrar with malafide intention and ulterior motives conveyed false and fabricated facts before the syndicate orally and without any agenda and succeeded in getting the resolution passed from the syndicate about the termination of the petitioners service, which resolution otherwise is without observing the due process of law. The petitioner filed an appeal dated December 18, 2010 against the arbitrary and discriminatory decision taken by the syndicate on November 27, 2010 and brought the actual and correct position to the notice of the authorities and in the end he prayed that the impugned resolution may be recalled and the petitioner may be allowed to continue to his post/position. He was verbally assured by the KU Vice Chancellor that his appeal would be placed before the next Syndicate to be held on January 29, 2011 and in the meanwhile suspended the termination decision and accepted his joining report allowing the Petitioner to resume his duties and issued the salary as well. However, in the said meeting of the Syndicate dated January 29, 2011, some amendment was made vide Resolution No.1, according to which word 'Lihaza (therefore) used in the earlier resolution passed as to the termination of the Petitioner was deleted and before that sign - was inserted with a malafide intention to give impression that the termination of the Petitioner was not due to the Petitioners absent from duty.
