SJC to take up code of conduct on 8th

ISLAMABAD- Chief Justice of Pakistan Iftikhar Muhammad Chaudhry has convened the meeting of Supreme Judicial Council (SJC) on August 8 to insert the new clause into the judges Code of Conduct, as was directed by the Supreme Court in its verdict in judges case. The meeting will be held in Supreme Court of Pakistan building. The Chief Justice, who is also Chairman NJC, would chair the meeting. Other four members of the Council are Supreme Court judges Justice Javed Iqbal and Justice Sardar Muhammad Raza Khan, Chief Justice Peshawar High Court Justice Tariq Pervez and Chief Justice Lahore High Court Justice Khawaja Muhammad Sharif. The meeting would also be attended by the registrar Supreme Court Dr Faqir Hussain, who is also Secretary SJC. According to a press statement issued here on Tuesday, the only item on the agenda of the Councils meeting is addition of a new clause to the Code of Conduct for the judges of the superior judiciary, as is required by the SCs Fridays judgment in judges case. The relevant portion of the judgment said: In the Code of Conduct prescribed for the Judges of the Superior Courts in terms of Article 209(8) of the Constitution, a new clause shall be added commanding that no such Judge shall, hereinafter, offer any support in whatever manner to any un-constitutional functionary who acquires power otherwise than through the modes envisaged by the Constitution and that any violation of the said clause would be deemed to be misconduct in terms of the said Article 209 of the Constitution. The press statement, however, further stated that the Council might also discuss any other item with the permission of its Chairman, the Chief Justice Iftikhar Muhammad Chaudhry. The same Council, in due course of time, would hear the references against the PCO judges, whose cases were referred to the Council by the Supreme Courts judgment in judges case. On Monday, while talking to journalists after oath-taking ceremony of former Chief Justice Sindh High Anwar Zaheer as judge of the Supreme Court, the Law Secretary Justice (Retd) Riaz Kiani had informed that the Law Ministry had received references against the twelve PCO judges of Lahore High Court. He had also said that after receiving such references from other high courts, the Law Ministry would refer these to the Prime Minister. The President, with the advice of the Prime Minister, would send the references to the SJC, he had explained. Attorney General, on the same occasion, had, however, said that the PCO judges could avoid proceedings against them in the SJC by rendering resignations. The SJC has no mandate to hear reference against retired judges or those judges who resign, he had said. On Tuesday, all the judges and Chief Justice of Balochistan High Court resigned from their offices.
