PM unlikely to act fast on Ministry's reminder

ISLAMABAD Prime Minister Syed Yousuf Raza Gilani is unlikely to act quickly on the reminder from Federal Law Ministry for early acceptance of the resignation tendered by Chairman National Accountability Bureau Naveed Ahsan, as his ouster from the office at this critical juncture would further aggravate prevailing tension and mistrust between the Government and the Supreme Court of Pakistan. It transpired from background interviews with the people aware of both overt and covert developments taking place on this front over the past fortnight that despite repeated requests to Prime Minister Gilani from Ministry of Law and Justice to accept the resignation tendered by Chairman NAB Naveed Ahsan at the earliest, the Premier was observing restraint as in the changed scenario, where Chairman NAB had carved out acceptability in the eyes of apex court, his ouster would not go well and the already tension and mistrust between the Government and superior judiciary would aggravate. Knowledgeable people in the Prime Minister Secretariat informed TheNation that Federal Minister for Law and Justice Dr Babar Awan was not credible in the eyes of Prime Minister Gilani but as he was blue-eyed of the Presidential Camp, he was calling the shots. These sources informed that by and large it was the view of some saner elements in the party that Dr Babar Awan was responsible for the present Government-Judiciary row and that was the reason Prime Minister Gilani was cautiously looking into matters forwarded to him from the Federal Law Ministry. The sources in the Prime Minister Secretariat informed that so far Prime Minister Gilani was not acting on the reminders from the Federal Law Ministry regarding the acceptance of the resignation of Chairman NAB but it would be difficult for the Premier in case the pressure from Presidency come in this regard. The sources revealed that Prime Minister Gilani was taking input of legal minds about the prevailing Government-Judiciary standoff and the safe way out from it and that was the reason he was very careful in all his acts as one wrong step on part of the Prime Minister Gilani would lead the things to direct confrontation between the institutions. The sources in the National Accountability Bureau confirmed that Chairman NAB had tendered his resignation on the demand of Prime Minister Gilani about couple of months back when there was tremendous pressure from the Supreme Court on the Government to implement the Courts verdict in NRO case wherein the Court had also sought the termination of Chairman NAB, Prosecutor General and Deputy Prosecutor General NAB. As for the termination of both Chairman NAB and Prosecutor General NAB a procedure of sending reference against them to the Supreme Judicial Council was required, the matter was delayed on which the apex court reprimanded the Government on several occasions. To get out of this difficult situation, the Prime Minister had called Chairman NAB, and after a brief discussion Chairman NAB Naveed Ahsan had tendered his resignation but showing courtesy the Prime Minister Gilani had asked him to go on long leave instead of his immediate and unceremonious ouster. But during the course of proceedings of NRO case, the apex court had directed Chairman NAB Naveed Ahsan, who was on leave leading to his ouster on termination of his contract, to appear before the court and he (Naveed Ahsan) duly complied with the court orders. The sources in the Department said that the apex court had itself overridden its earlier order wherein his immediate termination from the slot was sought, by directing Chairman NAB to come in and help the apex court. And later Chairman NAB Naveed Ahsan on the direction of the apex court had written letter to Swiss Government for reopening of the corruption cases against President Asif Ali Zardari and had been facing the wrath of the Federal Law Minister since that day. The sources further informed that in these circumstances, showing of door to Chairman NAB could backfire and keeping in view these considerations the Prime Minister Gilani was reluctant to accept his resignation as his ouster at this critical juncture could add fuel to fire and the Government-Judiciary relations, which were already at the lowest ebb, could turn into a direct confrontation. It was under these considerations that Premier Gilani a couple of days back in Karachi said that institutions should remain within their constitutional ambit, as the clash between the institutions would ruin everything.
