LAHORE Senior Advocate Tariq Aziz Malik on Thursday moved a petition before Supreme Court of Pakistan, challenging the notification about constituting Islamabad High Court (IHC). Filed before the Lahore registry of the SC, the petition maintained that it was discriminatory to establish this court only in one city. Pleading for establishing courts in every city, he said that there was no need of it as Rawalpindi Bench of the Lahore High Court is already functioning. He said law minister lied when he stated there were 25,000 lawyers in Islamabad and to facilitate them, the IHC was constituted. He said there were one only 1000 lawyers in the federal capital and they could approach the Rawalpindi bench. He said the nation was already under debt of 46 billion dollars and more expenditure on this exercise would amount to further burdening the nation. He said the SC had already declared the constitution of IHC as illegal and this new exercise was futile. He alleged that it was a move of the people in power having vested interest and it was for personal benefit of few persons who wanted to get the verdict of their own choice. He pleaded for invalidating the impugned notification. It may be recalled that the IHC was initially set up in 2007 under an ordinance that was then protected by the then president Pervez Musharrafs second PCO. When the SC declared the November 2007 PCO illegal on July 31, 2009, the IHC also ceased to exist. However, the court had asked the government to introduce new legislation to revive the court if considered necessary. The National Assembly on May 11 had passed a bill to establish a separate high court for Islamabad capital territory, which would have jurisdiction to hear the original, appellate and revision cases. The court would consist of a chief justice, to be appointed on rotation, and six other judges - one each from four provinces, Islamabad and FATA.
