Govt adamant on counsel of choice, SC told

ISLAMABAD The National Reconciliation Ordinance (NRO) review petition hearing was adjourned for two weeks on Tuesday as the 17-member bench could not be completed due to the absence of Justice Tassadaq Hussain Jillani on account of ailment. Chief Justice Iftikhar Muhammad Chaudhry announced that Justice Tassadaq Hussain Jillani was unwell and adjourned the case. Attorney General of Pakistan Maulvi Anwar-ul-Haq had assured the SC in the last hearing that he would consult the federation on the appointment of counsel. But when he appeared on Tuesday, he informed the Court that there was no change in the federal governments stance over changing counsel in the NRO review petition. He said: I have tried to convince the federation but it was sticking to its point regarding changing of counsel. The federation has filed an application in the SC contesting it had the right to change the lawyer.The chief justice on April 18, during the proceedings, had asked the Attorney General that if the federation was not willing to argue the case, then the court would start monitoring its judgment regarding the NRO implementation. The federations application states: It is undeniable right of a party to consult and be defended by a legal practitioner of his own choice as is guaranteed by Article 10 of the 1973 Constitution. It is the right of the federation to have consultation and be defended by the legal practitioner of the federations choice. The government has already expressed no confidence in its counsel Kamal Azfar, Attorney General for Pakistan Maulvi Anwar-ul-Haq, Additional Attorney General KK Agha and Advocate on Record Raja Abdul Ghafoor. The AGP and AAGP though had shown willingness to plead, but were given no instructions to appear in this case. The court was informed that Raja Ghafoor has not yet submitted his reply pertaining to the show cause notice issued to him and Nasir Ali Shah, Solicitor General of the Ministry of Law, Justice and Parliamentary Affairs, for making a false statement in the last hearing. The AGP, however, informed the bench that Nasir has prepared his response that would be filed later today (Tuesday). A senior lawyer, on the condition of anonymity, said with the adjournment of the case, the government has succeeded in tactics to delay the matter. He said now after two weeks when the NRO case would be taken up, the government would again present some excuses. He further stated that in May, Justice Raja Fayyaz Ahmed would retire then again there will be issue of non-completion of 17-member bench and the government will again have more time till the appointment of a new judge.
