ISLAMABAD - Chief Justice Iftikhar Ch Wednesday while hearing the presidential reference said the eyes from across the world were fixed on this case, and the court would answer questions raised in the reference. An 11-member bench of the apex court was hearing Zulfikar Ali Bhuttos murder case sent by President Zardari to the Supreme Court under Article 186 of the Constitution to seek its opinion. Attorney General for Pakistan (AGP) Maulvi Anwar-ul-Haq argued that the Lahore High Court acted as a trial court in the Bhuttos case, which was violation of the court orders. Justice Shakirullah Jan then inquired from him whether these irregularities were part of the presidential reference. Normally the execution is carried out after 7 to 21 days of a death warrant but in the Bhuttos case it was done in haste, the AGP added. The chief justice said the AGs arguments were in the same line with the presidents counsel, Babar Awan. The CJP advised the AG to present the constitutional and legal rationale and refrain from repeating the arguments of Babar Awan. He said: We need your expert opinion about the matter, and assistance to the court as an attorney general of the country. Justice Sarmad Jalal Osmany inquired whether all the questions mentioned in the reference were the questions of law? He further questioned whether bias and violation of fundamental rights are the questions of law? He said the conclusion drawn from the facts were not the questions of law. He, however, suggested to the AGP that ZA Bhuttos conviction could be termed as a law because the minority view of the seven-member bench was that approvers witnesses could not be incorporated in the judgment. He advised the AGP to say that the minority view was correct. Justice Jawwad stated if the words 'its effect and consequence on the verdict were excluded from second question then it becomes pure question of law. The court observed that determining of facts is civil or criminal courts jurisdiction. Justice Ghulam Rabbani stated: We are not hearing whether judgment against Bhutto was right or wrong. He said the whole world was aware of the judgment and for the last 35 years it had been discussed in media thoroughly. The CJP said even Ramsey Clark said that the judgment in Bhuttos murder case was 'a bad judgment. SM Zafar submitted his written arguments. According to his statement the court should make a strong suggestion to the govt and draw the attention of the parliament to frame a law to provide for correction of final judgments in criminal cases as and when it finds that real miscarriage of justice has taken place.
