ISLAMABAD - The Supreme Court on Monday observed that Pakistan is a sovereign country and therefore it doesn't like interference of anyone in its affairs. Chief Justice Iftikhar Muhammad Chaudhry, heading a two-member bench, hearing the petition filed by Senator Muhammad Ali Durrani regarding recovery of billions of dollars from the accounts of Pakistani politicians, bureaucrats, army generals, judges and businessmen said that though the title of the petition has been changed but no amendment is made in its body. The Chief Justice, therefore, directed the counsel for Durrani to delete all portions and paragraphs on that objection has been raised and submit it. The Chief Justice further ordered him to give detail of persons, who have taken money out of Pakistan and said how much money is lying in their foreign banks, within three days. The CJP said the money taken out of the country illegally is a matter of money laundering and for that the petitioners has to level allegation against the persons. Justice Khilji Arif Hussain, another member of the bench, stated the objective of the petitioner is noble and if he really wanted to help the country in recovery of national wealth from foreign banks then he should raise the issue in the Parliament as well. Senator Durrani has filed the petition through Mian Allah Nawaz under Article 184 (3) of the Constitution making as many as 27 respondents including the heads of Chairman Pakistan Peoples Party, President Pakistan Muslim League (Nawaz), President PML-Q and Convener MQM. The petitioner has prayed to the court that ambassadors of Switzerland, USA, UK, Canada, Germany, France, Spain, South Korea, Malaysia and UAE should be directed to facilitate in bringing back money from foreign countries. The SC Registrar had raised objections on the names of foreign ambassadors. Chief Justice Iftikhar Muhammad Chaudhry hearing the petition in his chamber on October 19, 2011 against the objections of SC Registrar Office directed the petitioner to drop the names of foreign ambassadors and decided to hear it in the court. Durrani in his petition has stated that certain Pakistani civilian and military officials, politicians, bureaucrats and businessmen have made money through illegal means and subsequently laundered it to Switzerland and other countries. He claimed that foreign assets have worth $400 billion to $500 billion. The PML-Q senator also said that according to the UN convention, this money belongs to Pakistan and the court should direct the government to bring it back. During the proceeding of the case, the Chief Justice said why did he thinks that only the politicians responsible of capital flight out of Pakistan, adding there were news that businessmen and industrial took their money out of Pakistan. He said huge capital flight took place and NRO was signed during the tenure of last government, in which Durrani was himself the minister. The case was adjourned for 15 days.
