Courts cannot interfere in govt policies, LHC told

LAHORE - The federal government told the Lahore High Court on the US drone attacks in Pakistan, that the issue pertains to the government policy matters and court of law did not have jurisdiction to initiate proceeding with it. The issue of US drone attack on Pakistan territory is before the standing committee of the parliament for discussion and decision, and the court jurisdiction is barred on the same as such, said the reply presented before the Bench of Justice Sheikh Azmat Saeed, through Deputy Attorney General Zia ul Qamar on behalf of the government to the petition filed by Ameer Jamaat-ud Dawa, Hafiz Muhammad Saeed on Friday. The government said the matter (pending before the parliamentary committee) is of a sensitive nature whose details cannot be brought before public or the court. Through AK Dogar Advocate, the petitioner seeks end to the US drone attacks as well as suspension of the NATO supplies to Afghanistan through Pakistani route. Petitioner counsel AK Dogar pleaded that US drone attacks are against sovereignty and dignity of Pakistan and its people and the federal government has failed to adopt a bold stand against America to seek stoppage of the attacks which are killing innocent Pakistani citizens. The petitioner urged the court to pass a direction to the government to take steps for stopping the drone attacks as a matter of protecting sovereignty of the country. AK Dogar requested the court for time to file rejoinder to the government reply and the court adjourned hearing till 7 October and also issued notices to the all respondent and parties for arguments on the petition on the next date of hearing. In the petitioner Hafiz Saeed also sought court directions for the government to execute a resolution passed by joint session of the Parliament on May 13 last, against drone attacks of US in Pakistan and cutting off the NATO supplies to Afghanistan. The petitioner said in the resolution it was pledged that Pakistan government would also cut NATO supplies to Afghanistan though its territory if the US continued drones attacks. He said but just after two day on May 15, about 10 people innocent people were martyred by US by a drone attack in Miranshah, headquarters of North Waziristan in Pakistan, in complete disrespect of the resolution. He contended that the government has failed to take preemptive measures against the drone attacks in Waziristan and other tribal areas as well as to implement the resolution. Citing provision of the law and articles of the Constitution, Hafiz Saeed said it is responsibility of the government to protect life and property of the citizens by exercising all powers and taking every step. He said it is also duty of the government to protect sovereignty and solidarity of country in case of any attacks on its territory or the dignity. Referring to the statement of Iranian president about the evil designs of America in the region against the Pakistans nuke, it is mandatory for the government to implement the resolution passed in joint session of the Parliament in greater national interest.
