RAWALPINDI - The trial court on Monday refused to separate military dictator and former President General (retired) Pervez Musharraf’s trial in PPP chairperson Benazir Bhutto (BB) murder case and decided that Musharraf would be tried along with other accused.The court also ordered that accused (Mush) would be formally indicted again, besides penning in the statements of 24 prosecution witnesses. Later, the hearing of the case was deferred till April 8, 2013. Anti-Terrorism Court (ATC) Judge Chaudhry Habib-ur-Rehman, who took up case at Adyala Jail, rejected the application filed by Federal Investigation Agency (FIA) Special Public Prosecutor Chaudhry Zulfiqar Ali he filed to speed up General (retd) Pervez Musharraf’s trial, a proclaimed offender and accused in BB murder case, as he had returned Pakistan.The judge remarked that the accused would be tried again while the statements of all the prosecution witnesses would also be recorded again. In his argument, Chaudhry Zulfiqar, the FIA Prosecutor, apprised that as per court direction during the last hearing to present the accused General (retd) Musharraf on the next date of hearing, it could not be done because Sindh High Court granted Mush protective bail in several cases.He asked the court should not start denovo trial of Musharraf as a huge delay had already been made in the case. He added that that in last six years, statements of 24 prosecution witnesses statements could be recorded while the defense lawyers yet to be cross examined the 6 prosecution witnesses.Chaudhry added that the trial court should conduct BB murder case trial on day to day basis following the clear orders of Lahore High Court (LHC) Rawalpindi Bench.    FIA Special Public Prosecutor also gave the reference of a Supreme Court of Pakistan’s verdict it laid in Inspector Raja Saqlain case in which the chief justice barred the trial court from conducting the denovo trial of a Proclaimed Offender (PO), had been arrested by law enforcement agencies.“Now General Musharraf has arrived Pakistan and is on bail. He should be trialed separately” the prosecutor requested the court.However, ATC No 1 Judge Chaudhry Habib-ur-Rehman set off the plea and directed trying Mush again besides indicting him again in BB murder case. The court also remarked that the statements of all the prosecution witnesses would be recorded again.The hearing of the case was postponed till 8 April 2013.In the court room, former City Police Officer (CPO)  Syed Saud Aziz, former SP Rawal Town Khurram Shehzad, the police officers on bails, and the five accused were also present.Chaudhry Zulfiqar, while talking to media, termed the verdict of ATC No 1 as injustice and vowed to knock the doors of LHC Rawalpindi Bench against the verdict. He also requested the SCP to take judicial notice of the order of ATC.  He said that at a time when the whole country was in grip of terrorists, such a slow pace in proceeding of terror related case might damage the peace process.
