ISLAMABAD - The Supreme Court on Wednesday reserved judgement on a petition against the appointment of Deputy Chairman NAB Javed Zia Qazi as acting Chairman NAB. A three-member bench, headed by Justice Javed Iqbal heard the petition against the appointment of Deputy Chairman NAB, filed by Wahabul Khairi. Justice Javed Iqbal observed that NAB had been totally ruined, as there is no Chairman and no Prosecutor General in NAB. Justice Asif Khosa remarked it was better to close the NAB, adding, that they could not shut their eyes on these matters. He also observed that prima facie the NAB was functioning illegally. He said that Deputy Chairman had no authority to withdraw the reference against any accused person. During the course of proceedings, the court also expressed its concern over the situation, prevailing in the NAB and directed the Attorney General of Pakistan to ask the government to appoint Chairman and Prosecutor General NAB immediately because the culprits were taking benefit in delay of their appointments. The court also observed that if the power would be transferred to lower officers of NAB then the question would arise about the eligibility of Chairman NAB. Wasim Sajjad, appearing on behalf of Deputy Chairman NAB, told the court that the petition was not maintainable as the NAB was running well, therefore, the court should not stop it from functioning. Justice Javed questioned that how the Deputy Chairman NAB withdrew the Civil Aviations reference. The AGP replied that former Chairman NAB Deedar Hussain Shah withdrew the reference. The court observed that it would deliver the judgement in view of the present situation, taking place in NAB.
